Ms. McKinley's practice focuses primarily on environmental and transportation law. In the area of environmental law, Ms. McKinley has counseled clients regarding environmental regulatory compliance, remediation of contaminated sites, CERCLA cost recovery, state voluntary cleanup programs, and environmental due diligence. Regarding her transportation law practice, Ms. McKinley has provided strategic advice to airport clients on issues ranging from noise to airport planning and environmental review. Ms. McKinley has also worked on highway projects and is familiar with the federal, state and regional approvals as well as environmental reviews needed for such projects.
Ms. McKinley has assisted local government clients with open records and open meetings issues and legislative drafting. Her practice also includes litigation in federal and state courts and before administrative agencies relating to airports, NEPA, and the enforcement of state environmental statutes.
Ms. McKinley's recent experience includes:
- Advising the redeveloper of a former military site regarding regulatory compliance of environmental remediation and necessary steps to seek cost recovery under CERCLA
- Advocating on behalf of municipal client opposing a highway project at the federal, state, and regional level
- Representing airport clients in administrative actions before the FAA
- Litigating a claim to enforce the right to quietude under the Minnesota Environmental Rights Act on behalf of the City of Minneapolis
- Securing a Colorado ID for a client through multiple layers of administrative and state court proceedings as a member of the Colorado Lawyers Committee Homeless ID Taskforce
